Dear Sub Officer Davey,
Fire services (Discipline) Regulations, 1985
I refer to the Regulation 7 notice served on you on 22nd July 1998, and the subsequent investigation into the allegations made against you conducted on my behalf by Divisional Officer Graham Smith.
The investigation has now been completed.
I am satisfied that you have committed one or more offences under the above Regulations. But, on this occasion, I do NOT intend to proceed with a formal charge or charges against you. The Regulation 7 notice dated 22nd July is hereby withdrawn.
This decision reflects your acknowledgement during interview under caution that you have acted wrongly, and your offer to forfeit time owing balance (my calculations suggest 100 hours of time owing) you have accrued as a consequence.
These are, however, serious failings on your part, especially since, as a rank holder, you cannot reasonably claim ignorance of the provisions of General Orders. I therefore intend to refer the matter to my Principal Officer colleagues for the question of positive managerial action to be considered. You should be aware that I believe an immediate transfer from the training department to an equivalent post elsewhere in the Brigade is warranted. Once we have agreed what managerial action will be taken, I will arrange to formally interview you with your union representative present to announce the decision.
For the avoidance of any doubt, this letter refers only to the regulation 7 notice served on 22 July. The second such notice, served on 7 august by DO Hodge, and the investigation thus notified, remains in force.
If you are in any doubt as to the meaning, effect or consequences of this letter, you should make your concerns known to me, either personally or through your Union representative, at the time you sign and return the copy enclosed.
