Not quite correct. The cause of illness was entirely the personal behaviour of Divisional Officer Colin Hodge.

‘He went sick on Friday 7th at approximately 1230 hrs (Colin Hodge will have noted the exact time). He had just been served with a section 7 letter, which he refused to accept and had “walked out” of the office.’

Bearing in mind the time is purported to have been written in Colin Hodge’s book at the event, and counter signed by ADO Paul Hayden the “will have noted” seems a little vague and an edge both ways. But then again maybe the notebook of Colin Hodge is not as contemporaneous as claimed?

As for the reporting of the event/incident by ADO Hayden, he seems to have forgotten it was a case of one party requesting trade union representation as agreed at corporate level, and the other party refusing!

Hmm an overt acknowledgement that the product requested can be adjusted and made to measure.

Sarah, I spoke at some length with Sub O Wigglesworth on his return to work, by which time, there were three issues outstanding. His original sickness was, according to him at the time, a result of the stress caused by being investigated in connection with a disciplinary offence. That was and is subject to investigation so I did not go into the matter in further detail. We also discussed his Station Officers assessment and his ongoing PDI. These were discussed, along with a general “what next?” with regard to his future. We agreed that we would need a further date to go through all of these issues in detail following his station Officers debrief, which was to be conducted by DO Chantry. As DO Batchelor was at BTC, I arranged for him to see Wigglesworth about his most immediate concern, how long he would have to serve in training school. Bob spoke to him, in my presence, that day and made a note for case about the outcome.

Although I was not here when he went sick on the first occasion, I believe that it was a similar set of circumstances this time. He went sick on Friday 7th at approximately 1230 hrs (Colin Hodge will have noted the exact time). He had just been served with a section 7 letter, which he refused to accept and had “walked out” of the office. A few minutes later, Colin and I were informed by the Sub of the watch, Roy Mitchell, that Wigglesworth had just asked him to “book him sick” and also asked him specifically to come upstairs and inform us that he was going off with “stress caused by our harassment” or words to that effect.

His first full day of absence was Monday 10th and I am not aware of any doctors note having been produced to date. Although we keep our own records and have the self certification books etc upstairs in the department, Wigglesworth booked sick using the station system. Therefore, it is possible that one has been produced “downstairs” on the station, in which case the self cert record will have been annotated and submitted to finance.

Sub Officer X or Wiggy if you prefer returned to duty at the Brigade Training Department in the attic of Lowestoft Fire Station on or around 12th August 1998. This being after the abusive altercation orchestrated by Divisional Officer Colin Hodge and inter-alia his rabid tearing apart of Wiggy’s mail marked PRIVATE & CONFIDENTIAL.

Come to think of it. Was Divisional Officer Colin Hodge’s recorded action that day a breach of the Fire service (Discipline) Regulations 1985?

Perhaps another Abuse of Authority?

YOUR CLAIM

I have today been contacted by Ms Linda Homer of Suffolk County Council with regard to your complaint of harassment. Ms Homer has telephoned me to assure me that while she respects your right to choose to leave this matter in the hands of myself and the industrial tribunal, if you choose to deal with the complaint of harassment through her, then you will receive no detrimental treatment.

I explained to Ms homer that you had adopted your stance purely because having already used a standard procedure in the Brigade (the near miss reporting procedure), you are now subsequently facing discipline charges. In those circumstances, your reluctance to invoke any Brigade procedures is entirely understandable.

Ms Homer has stated that the harassment procedure is a Council one and not a Brigade one and therefore there will be no undue influence from the Brigade or its senior officers.

I have read through the booklet that you have been given about the procedure. You clearly feel and indeed appear to be the victim of a process of harassment for whatever reason. Ms Homer appears to possess a genuine desire to address the issues you have raised with a view to reaching a satisfactory solution. Such a desire is commendable and can only be beneficial to the future relationship between you and the Brigade. The procedures cannot affect your claims to the industrial tribunal and therefore I cannot see any reason why you should not use the facilities being offered by Ms Homer to their full extent.

Reassuring to know it was written up almost a week after the events (11th August 1998). Suppose a lot of water has flowed under the brigade and many messages back an forth from BHQ Ipswich and Lowestoft in the intervening period?

Cor Blimey that Sub Officer Kieron Davey is a bit of a Rhum old boy isn’t he? Wonder what he was up to on 4th August 1998 if he wasn’t on union business? Wonder what ever happened to him?

‘I (ADO Paul Hayden) asked SubO Davey where Sub O Wigglesworth
was and he said that he believed that he was on leave.’

So he was informed Wiggy had taken leave. Seems our ADO Hayden also seemed to forget his instruction, to Sub Officer X and LFF Bartram for taking leave, made on 4th August 1998. Of course our ADO Paul Hayden has chosen to make any mention of LFF Bartram’s leave taken on 5th, 6th, and 7th August 1998 (see Doc 172). Wonder why that is? Maybe he just forgot. But then maybe it was because LFF Bartram wasn’t a FBU representative. But then maybe it for other reasons?

‘…….I also had a general check of his “in tray” and desk in case he had granted leave but not filed the request. However, I found no requests granted or otherwise.’

Just a “general check” though.

‘…Sub Officer Wigglesworth had booked one days miscellaneous Health & Safety leave for 5th August and one days scale A leave for 6th August’.

So it was already entered in the attendance record that Wiggy had paid for his leave, which seems to be the opposite of what Sub Officer Kieron Davey seems to have done.

‘With regard to Sub O Wigglesworth I was not aware from the records available to me that he had been granted 1 days Health and safety leave on Wednesday 5th August or 1 days scale A leave for Thursday 6th August’.

Oh we see it’s a problem about granting of leave.

‘I was particularly concerned that he had been expected to attend a meeting at HQ at 1000 hrs on Thursday 6th August.’

That doesn’t sound right at all, especially as X’s leave for 5th and 6th August and LFF Bartram’s also, was discussed with ADO Paul Hayden on 4th August 1998. No concerns of other engagements were raised by ADO Paul Hayden. Oh you are a naughty lying ADO Mr Hayden.

‘On checking Sub Officer Wigglesworth’s desk, I discovered a written order from Station Officer Parsons directing Sub Officer Wigglesworth to attend the meeting.’

Oh how handy!

‘I attempted to contact ACFO Tinley to reply to his initial query and make him aware of my other concerns.’

And probably also to advance his plan of collateral action to buffer the expected flack from Deputy Chief Fire Officer Simon Smith’s unlawful foul up.

‘I also attempted to contact Station Officer Parsons at home to find out if he had granted leave…..’

But no attempt to contact Sub Officer X at home by telephone to see what he was up to?’

‘During this time, I spoke to T/ADO Sayward who informed me that both he and the station receptionist, Shiela Huggins, had seen Sub Officer Wigglesworth on station that morning at approximately 0910 hrs in sports gear, but that he had left shortly afterwards.’

Spot on. Specifically for X to use the fax machine at Lowestoft Station to send a IT1 to Bury St Edmunds Employment Tribunal. Seems to omit that X told both witnesses he was on Leave and the reasons for it.

‘Whilst working in my office at approximately 1130 hrs, T/ADO Sayward and I observed Sub Officer Wigglesworth leaving the station in his car.’

Think he might mean bicycle. X returned to send the earlier fax again after he had checked if the earlier transmission had been received. As he was informed the receiving machine was defective he repeated the fax to another machine in the same building. But then perhaps ADO paul Hyaden is trying to infer X returned to the Station for some other jiggery-pokey. i.e. below.

‘However, on re-checking his desk, I discovered two requests for leave, one from SubO Davey, one from Sub O Wigglesworth. Both had been dated 5th August and were in respect of 6th August. They had been placed together on Station Officer Parsons desk underneath a memo dated 27.7.98.’ I reported to ACFO Tinley that I had discovered the leave requests on re-checking Station Officer Parsons desk and that although I had checked the desk earlier in the day I could not state categorically that they had not been there.’

Jolly good show old boy, splendid well done old chap.

On Wednesday 5th August 1998, I was asked by ACFO Tinley to confirm that SUB Officer Davey had been granted union leave for the afternoon of Tuesday 4th August. I was aware that such leave had been granted for 5th August, but had no knowledge of leave having been requested or granted for 4th August. In fact I believed that Sub Officer Davey had been working at Brigade Training Centre all day on 4th August as I had been discussing his work with him prior top leaving myself at approximately 1255 hrs. I returned to work at the BTC on Thursday…..

…..6th August, arriving at my desk at approximately 0820 hrs. at this stage, neither of the training instructors rostered for duty that day, Sub Officers Davey and Wigglesworth had arrived and I did not have a key to the instructors general office. I therefore carried on with routine work until approximately 1000 hrs when I went to the general instructors office. On entering the office, only Sub Officer Davey was present and he was dressed in a mixture of uniform shirt and jeans, engaged in FBU business on the telephone. When he had finished, I asked him if he was on or off duty, due to the manner of his dress. He stated that he was on duty at the time, but was about to go as he was on time owing leave. Taking Sub Officer Davey at his word I did not take the matter further at that time. While we were talking, a tanoy announcement was made for Sub Officer Wigglesworth, whom I later discovered was due to represent the department at a meeting in HQ at 1000 hrs. I asked SubO Davey where Sub O Wigglesworth was and he said that he believed that he was on leave. I then entered…..

………Station Officer Parsons Office to check his record of granted leave requests in respect of Sub Officer Davey’s leave taken on Tuesday 4th August. I found no records of leave requests relating to Sub Officer Davey’s leave taken on Tuesday 4th August, or relating to Sub Officer Davey or Wigglesworth for Thursday 6th August. As Station Officer Parsons was on annual leave, I also had a general check of his “in tray” and desk in case he had granted leave but not filed the request. However, I found no requests granted or otherwise. During this time, I understand that Sub Officer Davey left the building. ……Tuesday 4th August and had recorded on the Fin 4 that he had been on duty. This was despite the fact that I had been talking to him shortly before he had taken the leave, when he had given no indication of his intention to take it. Neither was I aware of any record that time owing leave had been granted in respect of Thursday 6th August. Further inspection of Sub O Davey’s records indicated that he had recorded a meeting with the DCFO and ACFO on Fin 3 (a) re-arranged overtime record on Tuesday 4th august, although no time value had been entered. With regard to Sub O Wigglesworth I was not aware from the records available to me that he had been granted 1 days Health and safety leave on Wednesday 5th August or 1 days scale A leave for Thursday 6th August. I was particularly concerned that he had been expected to attend a meeting at HQ at 1000 hrs on Thursday 6th August. Dear Steve,

I wish to make a formal complaint about the behaviour and actions of Divisional Officer Colin Hodge and Assistant Divisional Officer Paul Hayden. Both are, I believe, members of the Fire Brigades Union and subject to the rules of the union. The relevant facts are set out below for your consideration.

I was on duty at Lowestoft on 7th August 1998. At approximately 1200-1215 hours I was approached, by ADO Hayden, in the instructors office. ADO Hayden asked me to follow him into his office. He offered no explanation as to the reason.

I then asked ADO Hayden why he wanted to see me in his office. He replied with several sarcastic remarks including ‘it’s a surprise – follow me and you will find out.’

On entering ADO Hayden’s office I was confronted by an aggressive DO Colin Hodge. Straight away I informed both Do Hodge and ADO Hayden that I was uncomfortable in their presence and asked for a union official to be present with me.

DO Hodge replied (already knowing the answer), ‘is there one on station?’ I was later informed he had enquired about this with station personnel before arranging for me to be brought to ADO Hayden’s office.

I replied ‘No.’

Despite my perfectly reasonable request and established custom and practice DO Hodge refused to allow me the benefit of union representation. At the same time he became more aggressive and agitated.

His next action was to try and present me with a brown sealed envelope named to me and marked CONFIDENTIAL. Once more I requested the presence of a union representative and refused the envelope without my representative being present.

At this stage DO Hodge began shouting abuse and ordered me to open the letter complete with bizzare threats that if I did not open the CONFIDENTIAL letter in his presence I would be charged with mutiny, gross misconduct and all the other offences he could think of. At the same time he ordered ADO Hayden to make written notes. The latter stood motionless with his mouth open as DO Hodge seemed to lose control of his emotions and bladder.

Once more I declined his offer and asked for a union representative to be present.

DO Hodges next response with glace-cherry looking eyes was to wildly rip open the CONFIDENTIAL marked envelope addressed to myself and read it out at shouting pitch. Finally saying that I should sign it.

There was no way I was prepared to sign any document offered to me in such a violent manner.

I immediately withdrew from the office under severe strain and stress. All attributed to the wild behaviour of DO Colin Hodge. As I did so DO Hodge began chasing after me down the corridor like a mad man. I keep on running while looking back while ADO Hayden attempted to pacify DO Hodge.

I immediately took advice from Thompsons and booked sick with Sub officer Roy Mitchell who was the station duty watch officer. I informed Sub Officer Roy Mitchell that the cause of my sickness was the direct result of the violent and aggressive behaviour of DO Colin Hodge. In effect I had subject to a reportable injury. At the same time I duplicated this action by informing Mr Derek Lay at County Hall that I had booked sick.

Dear Chief Executive,

Thank you for your letter dated 7th August 1998.

With respect, I feel that your response is a bit inadequate. Especially in light of the overall circumstances and the fact that Deputy Chief Fire Officer Simon Smith has knowingly acted unlawfully. To that I add that you are of course fully aware of the unlawful act.

In consequence I have contacted my local county Councillor with a view to explore the possibility of an approach being made to the Ombudsman.

As to your concern about the involvement of the local media. I am unable to shed any light on that subject. Indeed, once more with the greatest respect, I fell there is nothing of controversial substance in your reply 30th July 1998, that would arouse any media interest. In all honesty, if I had chosen to inform the media my first port of call would be the Ipswich press.

Notwithstanding, I would add that the harassment, and all that is associated with it, to which I have now been subject to over the last nine to ten weeks has not gone unnoticed by my work colleagues at Lowestoft. Indeed, the current situation is, as far as I am aware, common knowledge throughout the Brigade. In my opinion I would suspect the source is probably Lowestoft based, but I am at a total loss to suggest who this might be?

Assuming the matter is now under media scrutiny I would ask you to refer any further approach to my solicitors who have now established contact with you. I also think it would be better in the interests of both parties that if you wish to make further communication with me you also go via my solicitors.

I refer to your letter of 26 July and my reply of 30 July 1998 and write to inform you of my proposed next steps.

Your letter makes a complaint of harassment under the County Council’s harassment policy. The first step in the procedure is to ask you to complete a report of harassment in accordance with the form provided in the back of the booklet “Procedure for dealing with Complaints of Harassment at Work”. Please give as much detail as you can of the incident or incidents you believe amount to harassment and the other information asked for in the form.

You do not need to fill in the form if it is easier to write out the information within a letter form.

Once I receive the additional information I will instigate the necessary investigation, and will follow the formal procedure set out on pages 6 & 7 of the guide.

Could I encourage you to read the guide to harassment and to consider getting support from a friend or a trade union official or harassment advisor, if you feel unsure about the report I’m asking you to complete or any aspect of the procedure.

Whilst writing I would also express my concern that the Lowestoft Journal has information about this matter. As I have shared your letter only with the County Director of Personnel and County Solicitor it would appear that the source of their information must be you. You may, therefore, like to comment on this whilst replying.

In accordance with the provisions of Regulation 7 of the above Regulations, I am writing to notify you that I have received information which leads me to believe that you may have committed an offence under the Fire Service (Discipline) Regulations, 1985.

It is my intention to carry out an investigation into this matter and I have appointed Divisional Officer Colin Hog to assist me. He will shortly be making arrangements to interview you in relation with this matter, and I would suggest that you use the opportunity to make a statement in reply.

DO Hodge’s attempt to rewrite events completely out of page chronology is quite extraordinary.

That said not quite as extraordinary as his wacky barm-pot explanation he has created to justify his actions in connection with opening mail marked PRIVATE & CONFIDENTIAL addressed to a person other than himself.

Isn’t it a shame he didn’t write this explanation at the appropriate time when it happened instead of after the event. Chances are he could then have found somebody to back up his wacky barm-pot rationale.
